Acceptance of These Terms
These Terms of Service ("Terms") are a binding agreement between you and Vivenar LLC ("Vivenar," "we," "us," or "our") governing access to and use of the Vivenar website, applications, and related services (collectively, the "Platform").
If you visit the Platform without signing in, you remain subject to these Terms to the extent they apply to general website use, including acceptable use, intellectual property, and disclaimers. When you create an account, publish a listing, submit or accept a booking request, make a payment, message other users through the Platform, or otherwise use authenticated features, you agree to these Terms.
Our Privacy Policy explains how Vivenar handles personal information. By using the Platform, you acknowledge that you have read the Privacy Policy. If you do not agree to these Terms, do not use the Platform.
The Platform and Vivenar’s Role
Vivenar operates an online marketplace for furnished medium-term stays. We help guests discover listings, submit booking requests, and pay hosts through the Platform. We help hosts publish listings, manage availability, respond to requests, and receive payments.
Hosts provide the accommodations. Guests pay hosts for stays through Stripe using the payment flows made available on the Platform. Hosts, not Vivenar, are responsible for the underlying stays, including the condition of the property, access, house rules, and compliance with applicable law.
Vivenar provides marketplace, request, messaging, calendar, payment-coordination, notification, and support infrastructure. We facilitate discovery, booking requests, on-platform payments, and related communications. When a booking is confirmed, the accommodation agreement is between the guest and the host; Vivenar is not a party to that agreement.
Vivenar is not the landlord, does not own or manage listed accommodations, is not the accommodation provider, and does not provide insurance.
Eligibility, Accounts, and Security
You must be at least 18 years old and able to form a binding contract to create an account, submit a booking request, or offer accommodations through the Platform. You must provide accurate registration information and keep your account details current.
You are responsible for activity that occurs under your account and for maintaining the confidentiality of your sign-in credentials. Notify us promptly at support@vivenar.com if you believe your account has been compromised.
We may require identity, contact, or verification steps before you take certain higher-trust actions, for example, publishing a listing, connecting a payout account as a host, submitting a booking request, or completing payment. You may create an account before completing every verification step, but some features will remain unavailable until requirements are met.
You may not create or use accounts in a deceptive or abusive manner, including by misrepresenting your identity, creating accounts to evade enforcement actions or platform limits, or misusing separately offered host fee arrangements or other incentives.
Host Responsibilities
If you publish or manage a listing, you represent that you have the legal authority to offer the accommodation and that your listing information is accurate, complete, and not misleading.
You are responsible for listing accuracy; your authority to offer the property; pricing and availability; honoring confirmed bookings; access and essential amenities as described; safety and habitability; permits, licensing, and other legal requirements; taxes; and the terms you disclose to guests, including house rules.
You must connect and maintain a valid Stripe account when required to receive payouts and to keep your listing bookable where the Platform requires it. You authorize Vivenar to share booking and payment information with Stripe as needed to facilitate payments and host billing.
Vivenar does not independently inspect, certify, or guarantee every listing or property. Hosts remain responsible for the accommodations they offer.
You must not discriminate unlawfully in offering or providing accommodations. Where applicable law prohibits discrimination in housing, lodging, or accommodations, you must comply with those requirements.
Guest Responsibilities
If you submit a booking request or stay in a listed accommodation, you must provide accurate stay details, comply with applicable law and the host’s disclosed house rules, and communicate promptly about arrival, access, and issues during the stay.
You are responsible for yourself, your occupants and invitees, required payments, and any damage or misuse you or they cause. You are not responsible for pre-existing defects, undisclosed property conditions, or failures attributable to the host or the property itself.
Before requesting a stay, you must meet any eligibility requirements shown on the Platform, which may include a complete profile, verified contact information, and other trust or verification steps.
You are responsible for reviewing listing details, pricing, cancellation terms, and house rules before submitting a request or completing payment.
Booking Requests, Bookings, and Payments
Vivenar uses a request-to-book model. A booking request is not a booking. Submitting a request does not guarantee a reservation. Availability may change until a booking is confirmed, and a temporary hold may apply after a host accepts a request while the guest completes the required first payment.
After you submit a request, the host has 24 hours to accept or decline it. If the host takes no action within that period, the pending request expires automatically.
A guest may not hold more than one active booking request for the same listing at a time, whether pending host response or accepted but not yet paid. Across the Platform, a guest may hold no more than three such active booking requests at once.
If a host accepts your request, you have 24 hours to start the required first payment through Stripe Checkout. After you start, you may finish within the short payment window shown in Checkout. If check-in is more than 14 days away at acceptance, the first payment is a 20% deposit and the remaining 80% is due 14 days before check-in. If check-in is 14 days away or sooner, the first payment is the full stay amount.
A booking and the guest–host accommodation agreement become binding only after the required first payment succeeds and the Platform records a confirmed booking. Until then, host acceptance does not create a confirmed reservation.
Guest stay payments are processed through Stripe and paid to the host’s connected Stripe account. Vivenar does not hold guest stay funds. When a deposit-and-balance payment structure applies, the remaining balance must be paid through guest-initiated Stripe Checkout. Vivenar does not automatically charge saved payment methods for balances off-session.
Displayed totals, due dates, and payment status are shown in the booking flow and on your request or booking detail pages. You are responsible for completing required payments by the stated deadlines.
Fees and Taxes
Hosts pay a Vivenar platform fee on stay payments made by the guest and received by the host through Vivenar’s payment flow. The standard rate is 5%. This applies to amounts actually paid through the Platform, whether as a deposit, balance, or full upfront payment, and not to unpaid amounts. Vivenar bills hosts separately for this fee. Current fee information is also described on our pricing pages and in host billing surfaces.
Vivenar does not add a separate guest service fee to the guest checkout total. Guest-facing totals reflect the pricing and charges shown to you before payment.
Stripe processing fees and applicable taxes on Vivenar’s platform fee are separate from the fee itself and are handled according to the applicable payment and billing arrangements.
Any fee waiver or other incentive offered to a host is subject to the terms provided with that offer.
Hosts and guests are responsible for determining and fulfilling any applicable taxes, duties, or government charges related to their use of the Platform or a stay, except where applicable law assigns that responsibility to Vivenar or another party.
Cancellations, Refunds, and Serious Stay Issues
Cancellation and refund outcomes depend on booking status, timing, who initiates the cancellation, and whether payment has been captured. To understand what applies to a stay, refer to the booking information shown on the Platform, the confirmed booking details, our published Cancellations and Refunds policy, and these Terms.
Requests canceled before host acceptance, declined requests, and requests canceled before required first payment generally involve no guest charge. After required first payment, cancellations and refunds are subject to review; submitting a cancellation request after payment does not by itself immediately move money or finalize cancellation.
After check-in, refunds are not automatic. Guests who experience serious property, safety, or misrepresentation issues should contact Vivenar support promptly and, when safe to do so, the host. Vivenar may request relevant evidence, such as photos, messages, or booking context, to evaluate a claim. Outcomes depend on the circumstances, including severity, timing, responsibility, the host’s response, and the portion of the stay affected.
Voluntary early departure after check-in is generally non-refundable unless an exception applies under the applicable cancellation rules or Vivenar determines otherwise after evidence-based review.
Messaging, Reports, and Platform Enforcement
The Platform provides messaging and reporting tools related to listings, booking requests, and bookings. You must use these tools lawfully and in good faith.
Vivenar does not routinely monitor all private messages. We may access or review messages and related records when reasonably necessary for customer support, safety, fraud investigation, dispute handling, legal compliance, or enforcement of these Terms and Platform policies.
You may report listings or user profiles that appear inaccurate, fraudulent, unsafe, or otherwise concerning using the reporting features provided on the Platform. Vivenar may investigate reports and take action, including removing content, restricting features, or suspending accounts.
If your account or access is restricted, you may contact support@vivenar.com to request review of the restriction. Vivenar may request additional information before making a decision.
User Content and Intellectual Property
You may submit content to the Platform ("User Content"), including listing photos, listing descriptions, public profile information, messages, and other material you provide. You retain ownership of your User Content subject to the rights described below.
For content you intentionally make public through the Platform, such as listing photos, listing descriptions, and public profile information, you grant Vivenar a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that content as reasonably necessary to operate and present the Platform, display and format listings, provide booking services, promote the relevant listing or the Vivenar marketplace, enforce these Terms, and protect users.
For private communications and other non-public content, you authorize Vivenar to process that material as reasonably necessary to provide messaging and booking services, provide support, investigate fraud or safety concerns, resolve disputes, enforce these Terms, comply with law, and retain records where reasonably necessary for bookings, disputes, fraud prevention, safety, enforcement, or legal obligations. Vivenar does not use private messages for promotional purposes.
You represent that you have the rights needed to submit User Content and that your User Content does not infringe third-party rights or violate applicable law.
Vivenar and its licensors own the Platform, including its software, branding, design, and documentation, except for User Content and third-party materials. You may not copy, modify, reverse engineer, or create derivative works of the Platform except as permitted by law or with our prior written consent.
Prohibited Conduct
You agree not to:
- use the Platform for unlawful activity, fraud, or deliberate misrepresentation, including misrepresenting a listing, identity, or payment status;
- attempt unauthorized access to accounts, systems, or data, or interfere with Platform operation or security;
- threaten, harass, or abuse other users or Vivenar personnel;
- upload harmful, illegal, or infringing content, or misuse another person’s information;
- create or use deceptive accounts to evade restrictions, limits, or enforcement actions;
- request or route payment for an active Vivenar booking outside the payment flow made available through the Platform.
Vivenar may also take action against conduct involving material fraud, unlawful activity, safety or security risk, material policy evasion, or material harm to users or the Platform, even if not expressly listed above, consistent with these Terms and applicable law.
Suspension and Termination
You may stop using the Platform at any time. You may contact support to request account closure.
We may suspend or terminate access to the Platform, remove content, or decline to process transactions if we reasonably believe you engaged in fraud or material misrepresentation; created a safety or security risk; engaged in unlawful conduct; failed required payment, billing, or payout setup; materially or repeatedly violated these Terms; abused other users or the Platform; or if we must do so to comply with law. We may act immediately where necessary for safety, fraud, security, or legal reasons. Where practical, we may provide notice before or after taking action.
We may also discontinue features or the Platform. Requesting account closure or terminating access does not eliminate payment obligations for confirmed bookings, outstanding disputes, or other liabilities that accrued before closure. Vivenar may retain records as needed for bookings, payments, disputes, safety, fraud prevention, enforcement, or legal obligations. Sections that by their nature should survive termination will survive, including provisions relating to fees owed, disclaimers, limitations of liability, and dispute-related terms.
Disclaimers
The Platform is provided as available. To the fullest extent permitted by law, Vivenar disclaims warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade with respect to the Platform itself.
Hosts, not Vivenar, provide the accommodations. Vivenar does not independently inspect or verify every property, listing, or user.
Vivenar does not guarantee that a host will accept a request, that a listing will meet a guest’s expectations, or that the Platform will be uninterrupted or error-free at all times.
Vivenar is not responsible for the acts or omissions of hosts, guests, or third-party service providers, except as expressly stated in these Terms or required by applicable law.
Limitation of Liability and Disputes
Nothing in these Terms limits rights or remedies that cannot be waived or limited under applicable law.
To the extent permitted by applicable law, Vivenar and its affiliates, officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Platform or any stay.
Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the above may not apply to you.
Guest–host disputes about a stay should first be addressed between the parties in good faith using Platform messaging where appropriate. Vivenar may facilitate communication, review relevant information, assist with resolution, and take action under these Terms, but does not guarantee a particular outcome.
If you have a dispute with Vivenar arising out of or related to these Terms or the Platform, contact legal@vivenar.com first so we can try to resolve it informally.
Changes to These Terms
We may update these Terms from time to time. Updated Terms apply from the effective date shown at the top of the page. When we make material changes, we will post the updated Terms on the Platform, update the “Last updated” date, and may provide notice by email or through a prominent in-product notice.
Where applicable law requires your affirmative acceptance, or where we determine that approach is appropriate for a material change, we may ask you to accept the updated Terms before continuing to use affected features.
Updated Terms do not retroactively alter the terms of a confirmed booking unless required by law or agreed by the affected guest and host.
If you do not agree to updated Terms, you must stop using the Platform.
