1. Introduction

This Privacy Policy explains how Vivenar LLC ("Vivenar," "we," "us," or "our") handles personal information when you visit our website, create an account, list a property, submit a booking request, communicate on the Platform, or otherwise interact with our services (collectively, the "Platform").

This Privacy Policy should be read together with our Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms.

Vivenar handles personal information as described in this Policy. Hosts and guests may also receive personal information from each other to evaluate, arrange, or perform a stay. They are responsible for using that information lawfully and appropriately.

2. Information We Collect

The information we collect depends on how you use the Platform, whether you act as a guest, host, or visitor, and which features you use.

Account and profile information

When you create or update an account, we collect information such as your name, email address, preferred language, home country, profile photo, short biography, and other profile fields you choose to provide. Depending on how you use the Platform, some of this information may appear publicly when you host or publish a listing, while other information may be visible only to the other party to a booking request or confirmed stay. The Platform controls how profile information is displayed in each context.

If you sign in with Google, Vivenar receives account information made available through Google sign-in, which may include your name, email address, and profile image.

Phone verification

When you verify a phone number, we collect the phone number you submit and verification status. SMS verification codes are sent and validated through Twilio Verify. Twilio processes phone numbers and related verification metadata as our service provider.

Listing and location information

Hosts provide listing information such as titles, descriptions, images, pricing, availability, house rules, amenities, and location details. Location information may include city, area, neighborhood, and address information needed to operate the listing and facilitate stays. Exact addresses are not displayed on public listing or search pages. Vivenar may share exact address or access information with people involved in a confirmed stay when reasonably necessary to facilitate that stay.

When a host connects an external calendar, Vivenar collects the calendar URL and availability information received from that calendar to help maintain listing availability.

Booking, payment, and refund information

When you submit booking requests, accept or decline requests, complete payments, or request cancellations or refunds, we collect request and booking details, pricing and payment status, payment deadlines, Stripe transaction identifiers and metadata, cancellation and refund records, and records related to Vivenar fees charged to hosts.

Payment card and bank details are collected and processed by Stripe. Vivenar receives payment status, amounts, Stripe identifiers, and related transaction metadata from Stripe but does not store full payment card numbers on our servers.

Messages, reports, notifications, and support

We process messages you send through Platform messaging connected to a booking request or booking, reports you submit about listings or user profiles, records of notifications we send, and information you provide when contacting support.

We send emails about account sign-in, booking updates, payment reminders, and other service-related communications through Resend. Resend processes the information needed to deliver those messages.

Authentication and session information

We collect information needed to sign you in, keep accounts secure, connect supported login methods, and revoke access where necessary. This may include session and account identifiers, sign-in records, and expiration information.

Photos and uploads

Profile photos and listing images you upload are stored using Amazon Web Services (AWS) and associated with your account or the relevant listing.

Logs and operational data

When you use the Platform, we and our service providers may collect technical information such as IP address, browser or device information, request metadata and timestamps, pages or features used, and error or diagnostic information.

Sentry receives error reports and relevant technical or account context to help us diagnose reliability, security, and operational issues.

3. How We Use Information

We use personal information to:

  • provide, maintain, and improve the Platform;
  • create and manage accounts and authenticate users;
  • enable listing publication, search, booking requests, and confirmed stays;
  • process payments and host billing through Stripe;
  • send service-related notifications and support communications;
  • verify phone numbers and enforce eligibility requirements;
  • review reports, trust and safety concerns, cancellations, and refunds;
  • detect, investigate, and help prevent fraud, abuse, and security incidents;
  • comply with law and respond to lawful requests;
  • analyze and debug Platform performance and reliability.

Vivenar does not use personal information to build third-party advertising profiles or for cross-site behavioral advertising.

4. How We Share Information

We share personal information in the following circumstances:

  • Between guests and hosts when needed to evaluate or perform a booking, for example, profile information, stay details, and messaging content shared within the relevant request or booking relationship.
  • With service providers that help operate the Platform, such as payment processing, email delivery, SMS verification, cloud hosting, file storage, and error monitoring.
  • For legal and safety reasons when we believe disclosure is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Vivenar, our users, or others.
  • Business transfers in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to appropriate confidentiality protections.

5. Service Providers

We use third-party providers to help operate the Platform. These providers process personal information to provide services to Vivenar or directly to users. Some providers may also process information under their own applicable terms and privacy notices. Vivenar remains responsible for its own handling of personal information under this Policy.

Our current service providers include:

  • Stripe: payment processing, Stripe Connect accounts, and host billing.
  • Resend: email delivery.
  • Twilio: SMS phone verification.
  • Amazon Web Services: storage of profile and listing images.
  • Sentry: error monitoring and diagnostic reporting.
  • Vercel: application hosting and delivery.
  • Google: sign-in, when you choose that option.

If we add or replace a material service provider, we will update this Policy as appropriate.

6. Cookies and Similar Technologies

We use cookies and similar browser storage to operate core Platform features, secure accounts, and remember preferences. These include:

  • Authentication session cookies to keep you signed in and to protect account access.
  • Locale preference cookie to remember your selected language (for example, English or Spanish) when you choose a language preference.

You can control cookies through your browser settings. Disabling cookies used for sign-in or core features may prevent you from using those features.

7. Data Retention

We retain personal information for as long as reasonably necessary to operate accounts and bookings, provide support, comply with legal, tax, and accounting obligations, resolve disputes, enforce agreements, and prevent fraud or abuse.

When information is no longer needed for these purposes, we take reasonable steps to delete, anonymize, or restrict access to it, subject to legal and operational requirements.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including access controls, secure transmission, and monitoring for unauthorized activity and operational errors.

No method of transmission or storage is completely secure. You are responsible for safeguarding your sign-in credentials and notifying us if you suspect unauthorized access to your account.

9. Your Privacy Choices and Requests

You may update certain profile information in your account settings.

You may request access to, correction of, or deletion of your personal information, or object to certain processing where applicable, by contacting privacy@vivenar.com. We may verify your identity before responding. Some records may be retained where necessary or permitted for bookings, payments, taxes, accounting, disputes, safety, fraud prevention, enforcement, or legal obligations.

You may ask Vivenar to stop non-essential promotional communications by contacting privacy@vivenar.com or by following any opt-out instructions provided in a communication. Vivenar may continue sending messages needed for account security, bookings, payments, support, or Platform operations.

10. Children and Minimum Age

You must be at least 18 years old to create an account, submit a booking request, or offer accommodations through Vivenar. The Platform is not directed to children. If you believe a child has provided personal information to us in connection with an account or booking activity, contact privacy@vivenar.com.

11. International Users

Vivenar is operated from the United States. Personal information may be processed in the United States and in other countries where we or our service providers operate.

Those countries may have data-protection laws that differ from the laws where you live.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated Policy on the Platform and change the effective or last-updated date shown at the top of the page.

When we make material changes, we may provide notice by email or through a prominent in-product notice. We will request consent where applicable law requires it.
